These terms are compliant with international standards (GDPR, CCPA) and payment processor requirements (Stripe).
Terms of Engagement
By engaging HEY VISUAL ("The Studio"), the Client agrees to these terms. The Studio provides architectural visualization and interactive sales tools, not architectural engineering or construction documentation.
Scope & Revisions
Services are defined by the specific Scope of Work (SOW), Quote, or Tier Selection provided. Any requests outside the approved SOW, or changes requested after specific approval milestones (e.g., "Style Lock" or "Clay Approval"), will be considered Additional Services and billed according to the terms outlined in your specific agreement.
Payments, Cancellations & Refunds
Stripe Compliance & Security
We utilize Stripe for secure payment processing. By making a payment, you agree to the following terms regarding cancellations and refunds.
Right to Decline & Refund
The Studio reserves the right to decline any project before production begins. If we receive a payment but determine that the provided inputs (plans, models, briefs) are insufficient, unclear, or do not meet our quality standards, we may cancel the engagement and issue a full refund immediately.
Payment Structure
Payment terms are specific to the service pillar engaged:
- Rapid Studio (Fixed Tiers): Typically requires full payment or a significant deposit upfront due to the accelerated nature of the delivery.
- Signature & Building Explorer: Terms are defined in your specific Quote (e.g., 50% deposit / 50% on completion).
Refund Policy on Active Work
Due to the custom, labor-intensive nature of our work:
- Deposits: Once production has officially commenced (post-briefing), deposits are non-refundable to cover studio time and resource allocation.
- Final Deliverables: Once final high-resolution assets are delivered, no refunds will be issued.
Delivery & Timelines
Method: All deliverables are digital. Files are delivered via secure cloud link (WeTransfer, Google Drive, or similar) sent to the Client's email address.
Estimated Timelines: Turnaround times vary significantly based on project complexity, scope, and client feedback speed. The estimates below are for reference only and are not guarantees unless explicitly stated in a Quote:
Timeline depends on milestones (Clay, Color, Final). Typical projects range from weeks to months depending on scale.
Designed for speed. First drafts are often available 48-72 hours after Style Lock, dependent on tier and input quality.
Interactive deliverables require technical setup, UI implementation, and pixel streaming configuration. Timelines are custom scoped per project.
Rapid Studio & AI Disclaimer
Nature of AI Outputs: Deliverables produced via the "Rapid Studio" pipeline utilize generative Artificial Intelligence. While HEY VISUAL employs professional "Human-Verified" review processes, these images are intended solely forconceptual marketing, mood, and pre-visualization purposes.
Not for Construction: Rapid Studio visuals must not be used for construction documentation, scale measurements, or structural engineering. The Studio is not liable for construction errors resulting from reliance on these visuals. For technical accuracy, please refer to our Signature Visualization services.
Privacy & Data Protection
HEY VISUAL is the Data Controller for information collected on this site. We comply with GDPR (Europe), CCPA (California), and LFPDPPP (Mexico).
Data Collection & Sharing
- Payment Data: Billing information is shared directly with Stripe for processing. We do not store full credit card numbers.
- Project Data: Architectural plans are treated as confidential and used solely for production.
- Cookies: We use minimal analytics cookies. You may opt-out via browser settings.
Analytics & Behavioral Tracking
We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products and services.
Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of our services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.
